-Translation- AIS-CP 136/2006 5 October 2006 Re: Clarification concerning Admission of the Plaint by the Supreme Administrative Court To The President The Stock Exchange of Thailand According to the news in the public source stating that the Supreme Administrative Court admitted the claim in respect of the government authorities neglect to revoke the concession agreements granted to Shin Corporation's group companies. In accordance with such case, the plaintiff filed the claim against the Ministry of Information and Communication Technology (ICT), Telephone Organization of Thailand (TOT) with the Ministry of Transportation, and the Office of the Permanent Secretary/ the Prime Minister Office due to their omission to inspect and revoke the Concession Agreements pursuant to the rules of frequency management and control. Advance Info Service Public Company Limited (ADVANC), according to the news, would like to clarify that such case and claim is an individual's claim filed for the omission of the government authorities for doing their duty according to the law which does not involve with ADVANC and that claim isn't an argument or dispute under the Concession Agreement between the grantor and the concessionaire. ADVANC still operates the business as usual and continues to manage and operate the business in accordance with the terms and conditions of the Concession Agreement. Upon receipt of any further update by the relevant party or any formal conclusion, ADVANC will promptly inform you the updated information. Please be informed accordingly. Yours Sincerely, -Signed- (Mr. Pong-Amorn Nimpoonsawat) Chief Finance Officer Advanced Info Service Public Company Limited
