With reference to the case which TOT Public Company Limited ("TOT") has submitted a dispute to the Arbitration Institute, ref. no. Black 9/2551, demanding Advanced Info Service Public Company Limited (the "Company") to pay additional revenue sharing for the total amount of Baht 31,462.51 million due to the deduction by Company of the excise tax from the revenue sharing delivered during 28 January 2003 to 26 February 2007. The Company would like to inform of the Arbitral Tribunal's Award of the above-mentioned case that on 20 May 2011 the Arbitral Tribunal has dismissed the case and TOT shall return the bank guarantee no. kor. 22270047549000 issued by The Siam Commercial Bank in the amount of THB. 1,304,640,000 to the Company. Note: This is the same case that the company has disclosed to the Stock Exchange of Thailand, AIS-CP 014/2011 on 3 February 2011, in Article 2. ______________________________________________________________________
